Social Media: A Powerful Weapon for Paralegals in Police ...

Social media has become a goldmine for investigations and discovery in civil litigation. To be sure, the popularity of social media has exploded in recent years. As of 2011, Facebook boasts more than 750 million active users, at least 50 percent of whom log on to Facebook on any given day. Twitter has more than 200 million registered users, with 460,000 new users joining every day, and an average of one billion tweets per week, according to The Huffington Post. LinkedIn claims it had more 100 million users and in excess of 2 million businesses with company pages. With increasing frequency, courts are finding that what a person posts on Facebook can be admitted in litigation.

DONT FRIEND THE OPPOSING PARTY

A paralegal or legal assistant may be asked to conduct research on Google, other search engines, or social networking sites for an opposing party, witness, or expert. The supervising attorney may have a legal assistant or paralegal save screen shots of someones Facebook account, then submit an affidavit or otherwise testify about the method in which the information was procured and produced.

Caution should be used, however, when trying to friend an opposing party or witness for litigation purposes. An article appearing in the January/February 2012 issue of Federal Lawyer Magazine, Christopher E. Parker, Travis B. Swearingen, Tweet Me Your Status: Social Media in Discovery and at Trial, 59-FEB Fed. Law. 34 (2012), the authors suggest that paralegals should not friend an opposing party or a witness to obtain information about a person on a social networking site. Courts and ethics opinions have concluded that conduct like this may violate ethical rules (see Philadelphia Bar Opinion 2009-2).

Rather than furtively gain access to a users account through a friend request, legal counsel can pursue information found on social media through traditional discovery, such as interrogatories and requests for production of documents. A paralegal may assist the attorney in drafting discovery requests or responding to discovery requests for information posted on a social networking site.

Besides the use of social media sites for investigations in civil litigation and employment screening, police and law enforcement officials are increasingly using social networking sites to gather information as part of investigations. Content posted on social media sites can serve as direct evidence of a particular crime. In addition, evidence can be used to illustrate the character and lifestyle of an accused person. For example, in 2005, photographs taken at a post-game riot after a Pennsylvania State University football game were posted on Facebook, which police then used to identify and cite about 50 students. Photographs of gang symbols, weapons, or tattoos posted on social networking sites can also be used to identify and gather information of suspects.

As powerful as social media can be as an investigation weapon, it can also be vulnerable to nefarious attack. In June 2012, for example, LinkedIn user data were jeopardized when its database was hacked and at least 6.5 million passwords were stolen and posted on a Russian hacker site. Many people will often use the same password for several sites, which opens up the possibility for hackers to gain unauthorized access to other websites.

In coming years, as social media becomes more widespread, using content and data posted on social networking sites for investigations will continue to increase. And as that need increases, rest assured that paralegals and others in the legal profession will have to have finely-tuned social media skills.

Marathon swimmer Palfrey readies for swim through shark-filled Florida Straits without cage

HAVANA - Penny Palfrey is trying to become the first woman to complete an unassisted swim 103 miles (166 kilometers) across the Straits of Florida without the aid of a shark cage.

The 49-year-old British-Australian mother of three and grandmother of two said Thursday that she was inspired to take on the shark-filled waters between Cuba and Florida last year when she flew from the Cayman Islands to Miami.

"I looked down, I could see this beautiful stretch of water, and wow!" she said. Palfrey got home and immediately began researching currents in the strait and its water temperatures, which are similar to a swim she made last year between Little Cayman and Grand Cayman islands.

"By then I'm already hooked," Palfrey said.

Australian Susie Maroney made the Cuba-to-Florida crossing in 1997 at the age of 22, but she swam with a shark cage. American Diana Nyad made two cageless attempts last year on either side of her 62nd birthday, but they were cut short by asthma attacks and jellyfish stings. Nyad plans to try again this summer.

Palfrey will be swimming without a wetsuit or a cage and relying on battery-powered Shark Shields attached to the boat and an accompanying kayak to keep the sharp-toothed predators at bay. The equipment generates an electrical field in the water that Palfrey will not notice, but will annoy sensitive-snouted sharks enough so they stay away.

To guard against Portuguese man o' war stings, which sunk Nyad's second and best attempt last summer, Palfrey will don a Lycra bodysuit that covers her down to her wrists and ankles whenever it seems jellyfish may be a problem.

"It's porous and non-buoyant so it doesn't aid me as a swimmer," she said. "In fact it's harder to swim because it creates drag and there's a lot more seams, so there's some chafing issues."

Palfrey had to call off two previous Hawaii swims due to Portuguese man o' war stings.

She was meeting with her crew and carbo-loading with a pasta dinner Thursday night in preparation of her morning departure from the Hemingway Marina in Havana. She expects to take 40-50 hours to swim to Florida, and said the currents will dictate where she lands.

A 44-foot (13-meter) catamaran dubbed the Sunluver will shadow her, carrying a support crew of navigators, kayakers, handlers, medical personnel and observers on hand to verify what would be a record swim. Every half-hour she'll sip a carbohydrate drink for nourishment.

Palfrey traversed the English Channel twice and also has completed a continuous swim from Gibraltar to Morocco and back.

Last year's 67-mile (108-kilometer) Caymans crossing is her personal best, but Palfrey said she's in good shape and 20 years of marathon swimming has her well-prepared for the 103 miles of the Florida Straits.

"It's further than I've ever swum before," she said. "I expect it to be very challenging, but I'm very excited about it.

Her attempt at the Florida Straits was delayed slightly by Tropical Storm Debby. Palfrey said Thursday that the weather and sea conditions look good for the next few days.

Lawmakers reach compromise on roads, student loans

WASHINGTON (AP) ? Facing weekend deadlines for action, congressional leaders have agreed to deals overhauling the nation's transportation programs without a Republican provision forcing approval of the proposed Keystone XL oil pipeline, and avoiding a doubling of interest rates for new student loans, congressional officials said Wednesday.

The agreements underscored the pressures both parties face to avoid angering voters and facing embarrassing headlines in the run-up to this November's presidential and congressional elections. Letting road-building programs grind to a halt during an economic downturn would be a blow to the image of lawmakers, while Democrats and Republicans alike seemed eager to avoid enraging millions of students and their parents by boosting the costs of college loans.

In contrast, enactment of the transportation measure would create or save 3 million jobs, said Sen. Barbara Boxer, D-Calif., chief sponsor of the Senate version of the bill. And the student loan measure would spare an estimated 7.4 million students who get subsidized Stafford loans beginning July 1 ? this Sunday ? from facing $1,000 in higher interest costs over the lives of their loans, which typically take over a decade to repay.

Congressional leaders were planning to combine the highway and student loan measures into a single bill to reduce potential procedural obstacles and hoped for final approval this week. Lawmakers would then leave Washington for a July 4 recess.

The two-year highway bill would prevent the government's authority to spend money on highways, bridges and transit systems from lapsing on Saturday, along with its ability to collect gasoline and diesel taxes. With both parties checkmating each other's top priorities this campaign season, Democrats and Republicans say the highway measure will be Congress' top job-creation initiative until the November elections.

"This is the jobs bill for the 112th Congress," said House Transportation Committee Chairman John Mica, R-Fla.

As the price for the highway agreement, lawmakers said Republicans dropped a House-approved provision requiring the government to approve the proposed Keystone pipeline, which is to move oil from western Canada to Texas' Gulf Coast.

Pipeline approval ? which prompted a veto threat from President Barack Obama ? has been a top goal this election year for the GOP, which has pitted its claims that it would create jobs against environmental worries that it could accelerate global warming and endanger Midwestern water supplies.

Republicans also agreed to abandon language blocking the Environmental Protection Agency from regulating the toxic ash generated by coal-fired power plants, lawmakers said. The ash is used as an ingredient in some types of cement.

In return, House Republicans won Senate concessions that would halve the time allowed for environmental reviews for highway projects, and squeeze money for bike paths and pedestrian safety projects by forcing them to compete with other transportation projects, said congressional aides and environmental lobbyists.

The bill would give states more flexibility in spending federal money, impose new safety regulations and expand a federal loan guarantee program to encourage private investments in transportation projects.

Despite the measure's short-term impact, the bill delays for two years decisions about a long-term funding scheme for highway and transit programs. Gas and diesel taxes no longer cover the cost of transportation programs and are forecast to bring in less revenue as the fuel efficiency of cars and trucks increases.

President Barack Obama spent weeks this spring touring college campuses and lambasting Republicans for not pushing a freeze on student loan rates through Congress. GOP presidential challenger Mitt Romney, looking to avoid handing Obama an issue, quickly said he favored the interest rate extension and congressional GOP leaders did too, though some Republicans think the government should not spend money to keep loan rates low.

The student loan pact would keep today's 3.4 percent interest rates on subsidized Stafford loans from doubling for new loans approved beginning on Sunday, an automatic increase that Congress enacted five years ago to save money. If they did double, it would affect 7.4 million students expected to get the loans over the 12 months beginning July 1, adding $1,000 to the interest costs of the typical borrower over each loan's life.

The tentative agreement was on the same package Senate Majority Leader Harry Reid, D-Nev., and Senate Minority Leader Mitch McConnell, R-Ky., had said Tuesday that they had shaken hands on, said a congressional Republican who spoke on condition of anonymity to describe the measure's status. McConnell said he expected the House to accept the agreement.

"We're moving, I think, towards an agreement on a transportation bill that would also include a one-year fix on the student loan rate increase," Boehner told reporters early Wednesday after meeting privately with House Republicans.

Some GOP lawmakers at that meeting said Boehner seemed to favor the emerging deal and said it received a positive reception.

"The general sense is there's a tremendous amount of support for getting it done," said Rep. Tom Reed, R-N.Y. "That's what's going to drive it across the finish line."

The two parties spent the last several weeks dueling over how to pay for the $6 billion cost of the student loan bill.

Under the agreement, the government would raise $5 billion by changing how companies calculate the money they have to set aside for pensions. That change would make their contributions more consistent from year to year and in effect reduce their payments initially, lowering the tax deductions they receive for their pension contributions.

Another $500 million would come from increasing the fees companies pay for the government to insure their pension plans, linking those fees to inflation.

In addition, $1.2 billion would be saved by limiting federal subsidies of Stafford loans to six years for undergraduates.

Lawmakers were discussing potentially wrapping in another Senate bill to reauthorize the national flood insurance program for five years.

The program, which provides federally backed insurance for 5.6 million households and businesses, many in flood-prone areas, has gone deeply into the red from claims after Hurricane Katrina in 2005. The Senate legislation would try to return the program to fiscal soundness through such steps as allowing premium increases and reducing subsidies for vacation homes.

Court ruling offers inmates rare chance at freedom

DETROIT (AP) ? The Supreme Court ruling that banned states from imposing mandatory life sentences on juveniles offers an unexpected chance at freedom to more than 2,000 inmates who had almost no hope they would ever get out.

In more than two dozen states, lawyers can now ask for new sentences. And judges will have discretion to look beyond the crime at other factors such as a prisoner's age at the time of the offense, the person's background and perhaps evidence that an inmate has changed while incarcerated.

"The sentence may still be the same," said Lawrence Wojcik, a Chicago lawyer who co-chairs the juvenile justice committee of the American Bar Association. "But even a sentence with a chance for parole gives hope."

Virtually all of the sentences in question are for murder. When Henry Hill was an illiterate 16-year-old, he was linked to a killing at a park in Saginaw County and convicted of aiding and abetting murder.

Hill had a gun, but he was never accused of firing the fatal shot. Nonetheless, the sentence was automatic: life without parole. He's spent the last 32 years in Michigan prisons.

"I was a 16-year-old with a mentality of a 9-year-old. I didn't understand what life without parole even meant," Hill, now 48, said Tuesday in a phone interview.

He heard about the Supreme Court decision while watching TV news in his cell.

"I got up hollering and rejoicing and praising God," said Hill, who would like to renovate homes and be a mentor to children if he's released. "The last three or four years, they always put young guys in with me."

The ruling also alarmed families of crime victims. Jessica Cooper, prosecutor in Oakland County, Mich., said her office has been taking calls from "distressed" relatives.

"Now they're going to start all over," Cooper said. "It's going to take years."

The Michigan Corrections Department said 364 inmates are serving mandatory life sentences for crimes they committed before turning 18. The prisoners now range in age from 16 to 67.

In Monday's 5-4 decision, the high court said life without parole for juveniles violates the Constitution's ban against cruel and unusual punishment. More than 2,000 people are in U.S. prisons under such a sentence, according to facts agreed on by attorneys for both sides of the case.

It's possible that some inmates will win immediate release. Judges could also impose new sentences carrying a specific number of years and a parole review. Some inmates could still be kept locked up for life.

"Judges have options," said Deborah LaBelle, a lawyer in Ann Arbor, Mich. "The Supreme Court said to look at juveniles individually: their age, family background, peer pressures, home environments."

LaBelle said she took a phone call from 34-year-old inmate Kevin Boyd, who was 16 when his mother killed his father. Boyd had given her the keys to his father's apartment, was aware of her threats and was convicted of murder.

After hearing of the court's decision, Boyd told LaBelle that he slept "with hope on my pillow for the first time in 15 years."

Back in 1996, Saulo Montalvo was a 16-year-old getaway driver in a fatal store robbery in Grand Rapids. He never stepped into the store but was convicted of murder and sent away for life.

"My mom and dad had gotten divorced, and I thought I had something to do with it," he said of his teen years. "I placed this burden on myself and began to act out. I gravitated toward people who were into minor crimes, drinking and smoking marijuana, and sought their acceptance. ... I was so broken by what I had done."

He said the victim's family has long forgiven him. And if released, Montalvo said, he could "be a benefit to the society I left behind."

The judge who sentenced him, Dennis Kolenda, didn't like the punishment but had to follow the law.

"A community that's got a soul has to recognize children are different, and we need to treat them as different," said Kolenda, who is now retired. "Some are incredibly dangerous, but we never know with kids how they're going to develop."

Michigan Attorney General Bill Schuette, who supported the state's life without parole law for juveniles, said crime victims won't be forgotten during the next round of court hearings.

"Every case has its unique set of facts," Schuette said. "We're going to make sure the truth is accurate."

Japan unveils 10% energy-saving target

Japan on Friday said its industrial heartland must cut electricity use by 10 percent this summer as the country grapples with a power shortage in the aftermath of last year's Fukushima atomic crisis.

A week after ordering the restart of two nuclear reactors, ending a brief period without any atomic power generation, the government said the expected shortfall would not be quite as bad as earlier thought.

Prime Minister Yoshihiko Noda and other senior ministers had previously said they wanted a 15 percent cut in peak electricity usage in and around the industrial hub of Osaka in western Japan from July to September.

But the bringing back online of two idled reactors at Oi has eased the expected crunch. The reactors are due to begin generating power in late July.

A power-saving order was issued last year as nuclear plants began to be shuttered in response to public disquiet over the technology in the months following the tsunami-sparked meltdowns at Fukushima.

But the cuts sparked complaints from businesses and fears manufacturers would move production overseas.

Prior to the quake-tsunami sparked Fukushima crisis, nuclear power supplied a third of Japan's electricity needs. In the months since, power companies have been increasingly dependent on imported -- and expensive -- fossil fuels.

Policymakers fear Japan's electricity demand could outstrip supply as summer temperatures soar and air-conditioners get cranked up, a worry for companies already battling uncertain economic times both at home and abroad.

U.S. close to seizing disputed dinosaur skeleton

(Reuters) - U.S. authorities said on Wednesday they expect this week to seize a 70-million-year-old dinosaur skeleton that was discovered in Mongolia more 65 years ago and now is stored in New York and at the center of an international legal dispute.

A federal judge in New York has signed a warrant that allows the U.S. Department of Homeland Security to seize the skeleton of the Tyrannosaurus bataar - an Asian cousin of the North American Tyrannosaurus rex - from Dallas-based Heritage Auctions.

"We should have it by the end of the week," said Luis Martinez, a spokesman for U.S. Immigration and Customs Enforcement.

The seizure will be a "major step forward" for the government of Mongolia, which is claiming sovereign ownership and seeking the skeleton's return, said Robert Painter, a Houston attorney who represents Mongolian President Elbegdorj Tsakhia.

The skeleton - 8 feet (2.4m) tall and 24 feet (7.3m) long - has been stored in crates in New York City since Heritage sold it at auction to an unidentified buyer for more than $1 million on May 20.

At the request of the Mongolian government, a U.S. District judge in Dallas issued a restraining order preventing the skeleton from being moved or the ownership transferred while the dispute is pending.

Manhattan U.S. Attorney Preet Bharara filed a lawsuit on Monday seeking the forfeiture of the nearly intact skeleton and its return to the Mongolian government.

In New York, U.S. District Judge Kevin Castel on Tuesday issued an order to seize the fossil, ruling there was probable cause it was subject to forfeiture under federal laws.

"From a legal standpoint, the U.S. government's lawsuit shifts the burden of proof from Mongolia to Heritage and others who might make a claim to its ownership," Painter said.

Heritage officials have said they will continue to cooperate with authorities. They say the skeleton was legally obtained and brought to auction by a reputable consignor.

"We believe our consignor purchased fossils in good faith, then spent a year of his life and considerable expense identifying, restoring, mounting and preparing what had previously been a much less valuable matrix of unassembled, underlying bones and bone fragments," Jim Halperin, co-chairman of Heritage Auctions, said in a statement. "We sincerely hope there is a just and fair outcome for all parties."

Federal officials said smugglers made false statements about the skeleton when it was imported into the United States from Britain in 2010. The skeleton did not originate in Britain nor was its value only $15,000 as claimed, they said.

The skeleton was discovered in 1946 during a joint Soviet-Mongolian expedition to the Gobi Desert in Mongolia's Omnogovi Province, Bharara said. Mongolia has had laws in place since 1924 prohibiting the export of dinosaur fossils that are considered national treasures and government property.

Heritage Auctions and the Mongolian government agreed in May to jointly investigate the ownership of the skeleton. Several paleontologists examined the skeleton several weeks ago and determined it was removed from the western Gobi Desert in Mongolia between 1995 and 2005.

About.me


AOL's online profile service, About.me (free), is practically the old man of personal Webpage sites, having launched way back in 2009. (AOL scooped it up in 2010.) The About.me homepage welcomes you with a display at the bottom of featured landing pages, so you can get an idea of what an About.me page will look like. The emphasis, as with Flavors.me (Free, 4.5 stars), is on a big photo as the background with accompanying links. About.me delivers big on that score, and entirely for free. Sadly it lacks some of the landing page features that would make it the leader while stressing unneeded social components.

Getting Started
Once you create an account (using your e-mail address, password, and picking an About.me URL), future sign-ins can be done via Facebook or Twitter. The About.me interface takes all the pain out of creating a site; you can easily upload a background image, enter your name, a "headline," and bio, and add links to just about any social/sharing/blogging service in the world, including Facebook profiles, Facebook Pages, Twitter, LinkedIn, Blogger, Google+, Wordpress, TypePad, Foursquare, Flicker, YouTube, Vimedo, Instagram, and others. All these links and data go in a text box that you can then position where you want on the background, relative to the most important part of the image. That's it?there's no extra special layouts to be had. As you resize the browser window the background will smartly resize as much as it can to maintain your layout.

Going Mobile
An About.me page looks good on a smartphone, where the page is reformatted to have the background graphic at the top and the text box info underneath. You can sign in and access features like stats while mobile, but can't edit the page. About.me has released an iPhone app that will let you change some of the text info (your headline and bio) but not all. The app description claims you can set a background image for mobile-only views, but I couldn't find it.

There's an option to activate an About.me email address for yourself, which is a nice feature if you want to keep your real email off the landing page to prevent spam. The service also excels at providing suggestions to get more visitors to your landing page, with suggestions on sharing the URL via social networks, links in other sites, and it has a form for submitting the URL (any URL, actually) to Bing and Google.

Weak Social
Where About.me loses me is its desire to be a low-rent social network. Stressed throughout the interface is the ability to find other users of the service and mark them as favorites. While I admit it might be nice if a Facebook profile page looked this good (there's a reason people hate the Timeline), I don't really want to find that small percentage of my friends and associates also have a landing page...because I already know them on the real social networks. Favoriting is a major facet of the iPhone app, which also has a "locate" feature so you can find people nearby with an About.me landing page.

Extras
There's no paid version of About.me, but it does a few offer "extras," in addition to the email address. It sells business cards for the cost of shipping ($5.50) from Moo.com that depict your landing page background image on the front and contact details on the back. There's a QR code to send people with smartphones directly to your page. Stats are just a click away, so you can see how many visitors you get (although not where they came from).

Sorely lacking is the ability to support a domain name of your choosing. It's a major quibble when projecting yourself out there is important and a domain name feature helps.

What's It All About?
What About.me lacks in paid features it more than makes up for with a perfect blend of simplicity and style. A few more bells and whistles for power-users would put it at the top of the landing page heap. As it is, however, Flavors is the clear Editors' Choice for a personal Web page.

(AP) ? Risking an election-year backlash from Republicans, the Obama administration is proposing new air quality standards to lower the amount of soot that can be released into the air.

The move, to be announced Friday, is likely to win support from environmental groups and public health advocates but exposes the president to potential criticism from congressional Republicans and industry officials that the rules are overly strict and could hurt economic growth and cause job losses in political swing states such as Ohio and Pennsylvania.

Perhaps wary of the rule's political risk, the administration had sought to delay the new soot standards until after the November elections. But a federal judge ordered officials to act after 11 states filed a lawsuit seeking a decision this year by the Environmental Protection Agency.

An administration official said the new rule was based on a rigorous scientific review. Virtually all counties in the United States would meet the proposed standard with no additional actions needed beyond compliance with current and impending rules set by the EPA, the official said. Administration officials described the rule to The Associated Press on condition of anonymity because it has yet to be announced.

Soot, made up of microscopic particles released from smokestacks, diesel trucks and buses, wood-burning stoves and other sources, contributes to haze and can burrow into lungs. Breathing in soot can cause lung and heart problems.

Dr. Albert Rizzo, chairman of the board of the American Lung Association, said soot, also known as fine particle pollution, is a known killer.

"The science is clear, and overwhelming evidence shows that particle pollution at levels currently labeled as officially 'safe' causes heart attacks, strokes and asthma attacks," he said.

Eleven states, including New York and California, filed suit earlier this year to force a decision. The states and the American Lung Association say current standards jeopardize public health. Soot has been linked to thousands of premature deaths each year, as well as aggravation of respiratory illnesses, heart attacks and strokes.

More than a dozen states, along with environmental groups, sued the EPA several years ago, contending that the Bush administration had ignored science and its own experts when it decided in 2006 not to lower the nearly decade-old annual standard for soot. The agency's own analysis found a lower standard recommended by scientific advisers would have prevented almost 2,000 premature deaths each year.

The EPA initially promised it would review recent science and issue a decision in 2011. After months of inaction, states led by New York filed suit to force a decision. The lung association and the National Parks Conservation Association filed a similar suit.

A federal court eventually ordered the EPA to propose a new rule by Thursday. A final rule is due in December after a public comment period.

The new rule would set the maximum allowable standard for soot in a range of 12 to 13 micrograms per cubic meter of air. The current annual standard is 15 micrograms per cubic meter.

Administration officials said the proposed changes are consistent with advice from independent scientists and are based on extensive research showing negative health impacts from soot at lower levels than previously understood. The agency will solicit comments from the public, as well as industry, public health groups and other interested groups to help determine the final standard.

Besides California and New York, states joining in the lawsuit forcing an EPA decision were Connecticut, Delaware, Maryland, Massachusetts, New Mexico, Oregon, Rhode Island, Vermont and Washington.

(AP) ? U.S. factories produced less in May than April, as automakers cut back on output for the first time in six months. The report indicates that manufacturing, a key driver of the economic growth, is slowing.

The Federal Reserve said Friday that factory output declined 0.4 percent last month, after increasing 0.7 percent in April. Auto production fell 1.5 percent, the first drop since November.

Overall industrial production, which includes mines and utilities, dipped 0.1 percent, after a solid 1 percent rise in April. Both mines and utilities increased production.

The production of computers, machinery, and aircraft all declined. The output of appliances also fell, while home electronics was unchanged from April.

The report "is another illustration of how rapidly the economy has lost momentum after a very strong start to the year," said Paul Ashworth, an economist at Capital Economics, in a note to clients.

Automakers ramped up output over the winter, boosting overall factory production. Auto production jumped at an annual rate of 41 percent in the first three months of the year. Manufacturing, meanwhile, rose nearly 10 percent on an annual basis in the same period.

Car sales rose sharply earlier this year but slowed in May.

Ashworth noted that average manufacturing output rose in the past three months at only a 2.4 percent annual rate.

He blamed the European financial crisis and slower growth in China, India and other emerging markets for hurting U.S. exports of factory goods.

Separately, a survey of manufacturers showed that factory activity in the New York region grew much more slowly in June than in May. The New York Federal Reserve Bank reported a reading of 2.3 for its June Empire State index, sharply lower than its 17.1 reading in May. That means factories barely expanded this month. A reading below zero indicated contraction.

A measure of new orders in the Empire State survey also fell.

Economists were disappointed by the drop in the regional survey.

"We had expected some weakness in the report ... but not to this degree," Joseph LaVorgna, an economist at Deutsche Bank, said in a note to clients.

The economy has slumped this spring after a promising winter. Hiring has sputtered and confidence has fallen. Consumers are spending less, which has slowed factory production.

Retail sales dipped in May for the second straight month, the government said Wednesday. It was the first back-to-back drop in two years.

Orders from businesses for machinery, computers and other capital equipment fell in April and March, according to a separate government report released earlier this month.

And the Institute for Supply Management, a trade group of purchasing managers, said manufacturing activity grew more slowly in May. Companies kept hiring, but not as quickly as in April.

Factories have been adding jobs at a healthy pace in the past two of years. But the sector isn't large enough to carry the whole economy.

Manufacturers added 12,000 jobs last month, the eighth straight gain. But overall, the economy generated only 69,000 jobs in May, the third straight month of sluggish hiring.

The economy grew at an annual rate of 1.9 percent in the January-March quarter. That's slower than the 3 percent growth in the October-December quarter.

(AP) ? One of the Obama administration's go-to civil rights groups in its efforts to build relationships with American Muslims is suing the New York Police Department over its surveillance programs, some of which were paid for with federal money.

Eight Muslims filed a federal lawsuit Wednesday in New Jersey to force the NYPD to end its surveillance and other intelligence-gathering practices targeting Muslims in the years after the 2001 terrorist attacks. The lawsuit alleged that the NYPD's activities were unconstitutional because they focused on people's religion, national origin and race.

It is the first lawsuit to directly challenge the NYPD's surveillance programs that targeted entire Muslim neighborhoods, chronicling the daily life of where people ate, prayed and got their hair cut. The surveillance was the subject of series of stories by The Associated Press that revealed the NYPD intelligence division infiltrated dozens of mosques and Muslim student groups and investigated hundreds.

The Muslims suing the NYPD are represented by Muslim Advocates, a California-based civil rights group that meets regularly with members of the Obama administration.

One of the lawsuit's plaintiffs stopped attending one New Jersey mosque after learning it was listed in an NYPD file. The mosque, like and dozens of others along the East Coast and listed in NYPD files, was not linked to terrorism either publicly or in the confidential police documents.

Syed Farhaj Hassan, a specialist in the U.S. Army Reserves, said he worried that if his name, or the name of one of his mosques, turned up in a police intelligence dossier, it could jeopardize his military security clearance or job prospects.

"Guilt by association is a career stopper, it's a show stopper, it's an ender," he said. "What happens when that name comes up when you're looking for a job?"

The Obama administration has offered few comments on the NYPD's programs, even as it released plans in the past year for local police departments around the country to counter violent extremism and build relationships in Muslim communities.

Since last fall, the Justice Department has been reviewing requests to investigate the NYPD. And President Barack Obama's counterterrorism adviser has said the NYPD does not appear to be breaking any laws. The NYPD has received large federal counterterrorism grants since the 2001 attacks, and a White House anti-drug program has helped pay for some of the NYPD's surveillance equipment.

When asked about the lawsuit Wednesday, NYPD Commissioner Raymond Kelly said, "I would just refer them to the New Jersey Attorney General's report that found no wrong doing."

Kelly was referring to findings from a three-month review that New Jersey's attorney general conducted in response to outrage over the NYPD operating secretly in New Jersey neighborhoods where Muslims lived and worked. The state attorney general found that the NYPD did not violate any state laws when it spied on Muslim neighborhoods and organizations, and found there is no recourse for the state of New Jersey to stop the NYPD from infiltrating Muslim student groups, video-taping mosque-goers or collecting their license plate numbers as they prayed.

No court has ruled that the NYPD programs were illegal. But the division operates without significant oversight: The New York City Council does not believe it has the expertise to oversee the intelligence division, and Congress believes the NYPD is not part of its jurisdiction even though the police department receives huge amounts of federal funding each year.

Kelly has said his department is obligated to do this type of surveillance in order to protect New York from another 9/11. He has said the 2001 attacks proved that New Yorkers could not rely solely on the federal government for protection, and the NYPD needed to enhance its efforts.

The lawsuit alleges that these enhancements violate constitutional rights.

"The NYPD program is founded upon a false and constitutionally impermissible premise: that Muslim religious identity is a legitimate criterion for selection of law-enforcement surveillance targets," according to the lawsuit.

Farhana Khera, executive director of Muslim Advocates, said, "There is no reason a police officer should be scribbling notes on little girls attending an elementary school."

The advocacy group, representing the plaintiffs for free, has a good and constructive relationship with the Obama administration, Khera said.

In 2009, Khera was the only representative from an American Muslim advocacy organization who was invited to attend the White House iftar dinner, a Muslim tradition of breaking the daily fast during the holy month of Ramadan, the group said. The organization was invited to a meeting at the White House in 2010 to discuss views on a Supreme Court vacancy. And the Justice Department invited the group to sit on a panel last year about confronting discrimination since 9/11.

Khera said her organization has asked the Obama administration to look into the NYPD's programs, and she thinks more could be done.

"We do not think that they've been given sufficient attention and attention in a speedy manner," Khera said. "We do think this is an immensely important issue to have the nation's largest police department targeting Americans based on religion. We do think it merits the attention of the federal government."

The White House said it would not comment on pending litigation.

The NYPD and New York officials have said the surveillance programs violated no one's constitutional rights, and the NYPD is allowed to travel anywhere to collect information. Officials have said NYPD lawyers closely review the intelligence division's programs.

Members of Congress and civil rights groups have urged the Justice Department to investigate the NYPD's practices. Federal investigations into police departments typically focus on police abuse or racial profiling in arrests. Since 9/11, the Justice Department has never publicly investigated a police department for its surveillance in national security investigations.

The NYPD has been limited by a court order in what intelligence it can gather on innocent people because of widespread civil rights abuses during the 1950s and 1960s. Lawyers in that case have questioned whether the post-9/11 spying violates that order. The lawsuit filed Wednesday is a separate legal challenge.

A George Washington University law professor, Jonathan Turley, said it would be a challenge to convince the government that the NYPD's practices were illegal because the courts and Congress have allowed more and more surveillance in the years since 9/11. But, he said, most of these questions have been handled in policy debates and not in the court systems.

Moiz Mohammed, a 19-year-old sophomore at Rutgers University, said he joined the lawsuit after reading reports that the NYPD had conducted surveillance of Muslim student groups at colleges across the Northeast, including his own.

"It's such an unfair thing going on: Here I am, I am an American citizen, I was born here, I am law abiding, I volunteer in my community, I have dialogues and good relationships with Muslims and non-Muslims alike, and the NYPD here is surveilling people like me?"

Mohammed said the revelations made him nervous to pray in public or engage in lively debates with fellow students ? a practice he said he once most enjoyed about the college atmosphere.

It is also a practice the Obama administration has said must be protected.

"Law enforcement has an obligation to ensure that members of every religious community enjoy the ability to worship and to practice their faith in peace, free from intimidation, violence or suspicion," Holder said in prepared remarks to a Muslim Advocates dinner in December 2010. "That is the right of all Americans. And it must be a reality for every citizen."

Turtle Beach partners with MLG, will unveil tournament-focused Ear Force Seven Series programmable headsets, TM1 audio mixer at E3

If you're familiar with Major League Gaming tournaments, you're likely aware that Astro Gaming's Mixamp Pro has been the staple device for providing multi-platform surround sound and team chat to the headset-wearing pros. Things are set to change this fall, however, as Turtle Beach has announced a partnership with MLG that'll usher in the release of its first ever tournament-focused gaming headsets and a long-overdue competitor to the Mixamp.

To start, the TM1 Tournament Mixer will be the exclusive sound hookup for MLG events when it hits the streets, effectively ending the reign of the Mixamp at events once it's out. The unit will provide virtual surround sound and chat functionality to any headset with a 3.5mm jack, albeit with some other enhancements. One TM1 can provide six players with individual sound whether they are on the same team or playing 3 vs. 3, and multiple devices can be daisy chained to provide a whopping 12 channels of separate audio. Notably, the TM1 also allows the broadcast audio to be fed into your mix, letting you can keep up with the crowd around you.

On the headset front, TB is blending its programmable audio know-how and recent foray into lifestyle headsets into what's dubbed as the Seven Series. Details are slim, but the first two models set to up the ante on the likes of Astro's A40 and the Sennheiser PC360 will be the Ear Force XP7 and Z7. Each headset features a portable design, detachable microphone and an optional inline remote / mic, so you won't be you stuck to only using 'em in your living room -- unlike pretty much of all the company's past headgear. You'll naturally be able to download your preferred audio settings using TB's Preset Community Portal, which will also include "presets customized for specific [MLG] tournament games."
